Agreement to Terms

By accessing or using Yogi Breath services, including our mobile application, website, courses, live classes, and coaching services (collectively, "Services"), operated by Creative Toolbox (S) Pte Ltd, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use our Services.

Services Description

Yogi Breath provides:

Mobile application for iOS with guided breathwork exercises
Website with information and resources
Video courses on breathwork techniques
Live online group classes
One-on-one coaching sessions

All Services are provided for general wellness and educational purposes only.

App Subscriptions and Purchases

iOS App

The Yogi Breath mobile application is available through the Apple App Store. All in-app purchases and subscriptions are subject to Apple's Terms and Conditions and the Licensed Application End User License Agreement (EULA).

Subscription Terms

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Payment is charged to your Apple ID account at confirmation of purchase
Subscriptions may be managed and auto-renewal turned off in Apple ID Account Settings
No refunds for unused portions of subscription periods
Pricing may vary by region and is displayed in your local currency

Lifetime Purchase

Lifetime access is a one-time purchase providing permanent access to app features. This is tied to your Apple ID and can be restored on any device signed in with that account.

Website Services

Video Courses

Courses are purchased individually with one-time payment
Access is granted immediately upon successful payment
Lifetime access to purchased course content
Courses are for personal use only and may not be shared or redistributed
We reserve the right to update course content

Live Classes

Classes are conducted via Zoom or similar video platform
Booking confirmation and access link sent via email
Cancellation policy applies (see Refund Policy)
Class recordings available for 7 days when applicable
We reserve the right to cancel classes with full refund

Coaching Services

Sessions are conducted via video call
Scheduling through our booking system
Cancellation policy applies (see Refund Policy)
Coaching is for wellness guidance only, not medical treatment

User Responsibilities

You agree to:

Provide accurate information when required
Use Services only for lawful purposes
Not share your account access with others
Not reproduce, distribute, or create derivative works from our content
Not attempt to reverse engineer or hack our Services
Consult healthcare providers before starting breathwork practice
Practice breathwork safely and stop if you experience discomfort

Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, images, audio, video, and software, are owned by Yogi Breath or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not:

Copy, modify, or distribute our content without permission
Use our trademarks or branding without authorization
Record, screenshot, or redistribute course or class content
Use our Services for commercial purposes without agreement

Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Warranties that Services will be uninterrupted or error-free
Warranties regarding accuracy or reliability of content
Warranties of specific results or outcomes

Limitation of Liability

To the fullest extent permitted by law, Yogi Breath, its owners, employees, instructors, and affiliates shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Personal injury or property damage
Any damages arising from use or inability to use our Services

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Yogi Breath and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of our Services
Your violation of these Terms
Your violation of any rights of another party
Your breathwork practice and any resulting injury

Termination

We reserve the right to:

Suspend or terminate your access to Services at any time
Remove or disable content at our discretion
Refuse service to anyone for any reason

You may terminate your use of Services at any time by:

Cancelling subscriptions through Apple ID settings
Deleting the app from your device
Ceasing to use our website and services

Changes to Services

We reserve the right to:

Modify or discontinue Services at any time
Change pricing with notice to existing subscribers
Update app features and content
Modify course content and class schedules

Governing Law

These Terms are governed by the laws of the United States and the state in which Yogi Breath operates, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or use of Services shall be resolved through:

Good faith negotiation between parties
Mediation if negotiation fails
Binding arbitration if mediation fails

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Disclaimer, Refund Policy, and Cookie Policy, constitute the entire agreement between you and Yogi Breath regarding use of our Services.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

Updating the "Last updated" date
Sending email notification for significant changes

Continued use of Services after changes constitutes acceptance of updated Terms.
